Ex-Gratia case:

Although , the matter was listed in the list of business of the Hon’ble High Court of Delhi on 16.03.2012, the case could not be heard and the next date of hearing has been fixed on 11th May,2012.

At Jaipur , a CIVIL WRIT 3207 of 2007- SANTOSH KUMAR SHARMA Vs. R B I, MUMBAI was Listed On 29/02/2012 for filing of an amendment to the Petition. The bank's counsel opposed the amendment and referred to the Karnataka Court's recent judgement. However, the ammendment to the Petition has been allowed by the hon'ble High court at Jaipur and the petition has been admitted for hearing in due course.

Since the Hon’ble High Court of Karnataka has set aside  a similar petition filed and our Counsels after carefully examining the judgment of the said High Court are of the view that an appeal in Division Bench of the court should be filed by any of the Petitioners concerned.  We have impressed upon the  petitioners at Bangalore for filing a  suitable appeal before the Division Bench of the Hon’ble High Court in Karnataka.

In view of this development our responsibilities are increased and we shall have to be prepared to carry forward the fight with courage and determination even if it becomes necessary for us to approach the Hon’ble Supreme Court in this regard. We shall keep you informed in the matter.

In the meantime we request other units who have filed such cases at the various High Courts to take steps to get their cases being heard and developments if any in their cases may be communicated to us.

Pension Updation:

It is learnt that the matter is being pursued with the M/o finance at appropriate level by the Bank , the final outcome of which may be known soon.

All India Reserve Bank OERS Pensioners Forum appeals to the Top Management and Central Board of the Bank to sanction approval to the demand of periodic updation of Pension and Family Pension by all the retirees that include the family members of the earlier top Management of the Bank.

Sanction of this just demand , no doubt, is long awaited and not only will bring a sense of relief to the retirees who are constantly fighting the erosion of intrinsic value of the pension but also enhance the image of the RBI as a Model employer-AIRBIOPF

M/o Finance, have passed a speaking order F.No.16/1/58/2008-IR dated 23-10-09 against the petiotioners(Retirees), after hearing them through their Associations and deliberations with the Bank. Extracts of letter dated 16th October to Governor by RBI New Delhi OERS Optees & Pensioners Welfare Association...
after a lapse of more than 2 months, the TPA has failed to deliver the cards to about 100-150 retirees at Delhi...A lot of only 47 undelivered cards has been received by the medical section at Delhi office till 27th September 2011...Such a large number of undelivered cards has been reported for the first time since the inception of the scheme. ...Your good self will agree that the delivery of cards is not optional for the TPA and the RBI should not limit its role to payment of premium to the company. We hope that necessary remedial steps will be taken immediately... for the benefit of retirees..

Supreme Court upholds exemptions u/s 10(10C) to OERS optees

On 21-10-2009 Supreme Court gave final verdict in SLP 15805-10/2008 and set aside Madras High Court's Orders against the OERS optees-Chandra Ranganathan & Ors and restored the Tribunal's order.Supreme Court's decision ,no doubt is a severe set back and shocking to those sadistic elements in RBI and Govt who always wanted the optees to be deprived of the benefits u/s 1O (1OC).This victory is the result of the constant struggle waged by Chennai Unit under the inspiring leadership of PS Rajan,Secy. Consequently,now it would be open to the OERS retirees, who have not claimed refunds , to claim the same without any restriction as regards period of limitation prescribed under Section 239 of the Income Tax Act, 1961.
Central Board of Direct Taxes (CBDT)had earlier issued a circular dated 8th May 2009 , as a compliance with Bombay High Court's order dated 4th July 2008 wherein it was held that Optional Early Retirement Scheme of RBI satisfies all the conditions of Rule 2BA and amounts received by retiring employees there under were eligible for exemption u/s 1O (1OC). <<<Read More>>>

 

Dark assertions reflecting shadows behind illuminated jubilee in RBI.

At 8 centres,viz.Kolkatta,Nagpur,Mumbai,Bhubneswar,Delhi,
Chandigarh, Hyderabad,and Banglore - Petitions have been filed in respective High Courts praying to declare our revised pay as on Ist November 2002 as 'Pay' for the purpose of calculation and payment of ex-gratia as provided in clause 5 of the OERS scheme and direct the RBI to pay ex-gratia on the basis of revised "Pay' held by OERS optees on the date of retirement.

Sh.Kishore Chakraborty has written a letter to the Governor requesting him to set right the erroneous administrative decision as a responsive governor.

WHY FORUM ?

What is OERS?

RBI introduced (OERS) in Aug 03 on the frame work of the Voluntary Retirement Scheme (VRS) for Public Sector Banks.

In 2001-02, the PSBs had introduced VRS to get rid of surplus staff.

Facts about Voluntary retirement Schemes(VRS).

Whatever may be the name, a VRS is never introduced for the benefit of the employees who opt for it.

It is always introduced to enhance or maintain the profits of the concerned Management.

It is a tool to lure and retire the surplus workforce;And even IT act was amended to make such schemes attractive.

With liberisation of Indian economy (1991-92) came Foreign funds, advanced technology,capital investments that rendered the workforce surplus.As Indian laws do not allow easy reduction of workers, the concept of V R Schemes came into being.

No sane person has so far claimed that the schemes were introduced for the benefit of the employees only.

Mission:

To create a sense of brotherhood ,
co-operation, mutual harmony, among the Optees/ Pensioners /members and work for their welfare.

To meet the challenges of the changing scenario in the society caused by the increasing numbers of the retirees/their dependants,due to various retirement options (compulsory,voluntary or normal) and of their socioeconomic, psychological and age care needs.

To raise funds for creation of facilities especially designed to benefit the elderly and thus to improve the quality of their lives.

To highlight the positive and continuing contribution of the retirees/elderly in enriching and strengthening society, economy and polity.

To approach and appeal and represent to the authorities concerned by lawful and legal means for the solution of the problems faced by members, other RBI pensioners, retirees and dependants.
